BayDesk

Privacy Policy

Last updated October 16, 2026

BayDesk is operated by Rafael Soares Reis Costa. This policy explains what we collect when shops use BayDesk and when people call those shops, and how we handle it. Version 2026-10-16.

Our role

For the calls BayDesk answers, we act as the shop's service provider: we handle callers' information on the shop's behalf and under its instructions, and each shop is responsible for its own use of that information. If you called a shop, you can contact that shop, or us, about your information.

What we collect

How we use it

We don't sell personal information or share it for targeted advertising, we don't use call data for advertising, and we don't use it to train AI models.

Who we share it with

Only with the providers that run the service for us, each for its part of the job:

They process information to provide their services to us, under their own terms and privacy policies. We may also disclose information when the law requires it, to protect someone's safety, or as part of a merger or sale of the business.

Voices

BayDesk doesn't use callers' voices to identify them and doesn't create voiceprints. If we offer a custom assistant voice based on a real person's voice (such as a shop owner's), we create it only with that person's signed consent, use it only for that shop's assistant, never sell it, and delete the voice and its sample recordings within 30 days after the person withdraws consent, the shop stops using it or the account ends, and in any case within 3 years of the person's last interaction with us.

Text messages

A shop's BayDesk line texts a caller only after the caller agrees on the call. Reply STOP to any text to opt out, or HELP for help. Message and data rates may apply. Consent to texts is never a condition of service. We don't share mobile numbers or text-message consent with third parties for their marketing.

How long we keep it

Call recordings, transcripts and messages are kept while the shop's account is active so the shop can review them. The shop can download its call history anytime. After an account ends, we keep them for 90 days so the shop can download a copy, and then delete them (unless the law requires us to keep them longer, for example during a legal dispute); copies in our backups are overwritten within 30 days after that. Billing records, account records and acceptance records are kept as long as the law requires or as needed to resolve disputes.

Your choices

Shop owners can see and download their call history in their dashboard and can ask us for a full copy or deletion. Callers can ask the shop, or us at hello@usebaydesk.com, to access or delete their call records; we verify the request and respond within 15 days. Depending on your state, you may have additional rights, and we honor them.

Children

BayDesk is a service for businesses and isn't directed to children under 13.

Security and location

We use encrypted connections, hashed passwords, access controls, activity logs and daily backups. No system is perfectly secure; if a security incident affects your information, we'll notify the affected shops without undue delay, and the people affected when the law requires. BayDesk is operated from Brazil, and we and our providers may process data in the United States, Brazil and other countries.

Changes and contact

If we change this policy in a way that matters, we'll update the version above and email shop owners before the change takes effect. Questions: hello@usebaydesk.com.
